Vacation rules per company

How remaining vacation is handled, super admins set per company under Admin → Companies → (company) → Vacation account. Klokk keeps every person’s vacation account accordingly. The rules follow German law (BUrlG, BEEG).

Setting Meaning
Carry remaining days into the next year What is left at the end of the year moves to the next one. Off: remaining days expire at the end of the year (after notice in time).
Carried-over days expire At the end of which month carried days expire — or never. Usual is the end of March (§ 7 (3) BUrlG).
Carry at most A cap in days; empty: all.
Give notice of remaining days Notices by e-mail and on the dashboard (see below).
Vacation account in Klokk from year From when Klokk keeps the account; Klokk does not know earlier remaining days — book them as an adjustment if needed.
Reduce vacation for full months of parental leave A twelfth of the annual vacation per full calendar month of parental leave (§ 17 BEEG).
  • Carried days are used first.
  • They expire at the end of the set month — but only if the person was told about their remaining days in time (German Federal Labour Court, 19.02.2019, 9 AZR 423/16). Without such a notice the days are kept.
  • Whoever is sick, on parental leave or in maternity protection on the deadline keeps the days too. Admins can adjust the account with an adjustment if needed.
  • Whoever took more vacation than due carries the negative balance into the next year.

With notices switched on, everyone with remaining days receives an e-mail from 1 October and a notice on the dashboard that they confirm. It names the days and by when they should be taken. Only a notice given in time lets carried days expire.

  • Joining: whoever starts after 1 July does not complete the six-month waiting period (§ 4 BUrlG) in the year of joining and receives a twelfth of the annual vacation per full month of employment (§ 5 (1) a BUrlG).
  • Leaving: in the year of leaving nothing expires and nothing is carried over: remaining days are to be paid out (§ 7 (4) BUrlG). Whoever leaves before the end of the waiting period or by 30 June receives a twelfth per full month (§ 5 (1) b, c BUrlG).

The reduction under § 17 BEEG is a declaration by the employer that must be communicated to the person — so it is off by default. Switched on, Klokk deducts a twelfth of the annual vacation for every calendar month fully covered by approved parental leave.

If the person works part-time during parental leave, those months must not be reduced. Klokk does not detect this by itself: balance the vacation account with an adjustment then.

When old records are deleted under the deletion periods, Klokk freezes the vacation years concerned beforehand: their figures stay as they were.
